Terms of Service

1. Acceptance of Terms
By accessing or using the Indigo Lease platform (“Service”), operated by Indigo Lease (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Indigo Lease is a property management platform that enables property managers (“Landlords”) to manage properties, units, tenants, and leases, and enables tenants (“Tenants”) to view leases, sign documents, and manage their rental information. The Service may also provide example lease templates for reference purposes.
3. User Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
You must promptly notify us of any unauthorized use of your account.
4. Landlord-Tenant Relationships
Indigo Lease is a technology platform only. We are not a party to any lease agreement, rental arrangement, or other contract between Landlords and Tenants.
We do not guarantee, endorse, or assume responsibility for any agreement, lease terms, property conditions, rental payments, security deposits, or any other aspect of the landlord-tenant relationship. Any disputes between Landlords and Tenants must be resolved between those parties directly.
Example lease templates or documents provided through the Service are for informational and reference purposes only. They do not constitute legal advice and may not comply with the laws of your jurisdiction. You are solely responsible for ensuring that any lease or agreement you enter into complies with all applicable local, state, and federal laws.
5. Payment Processing
Indigo Lease facilitates connections between Landlords and third-party payment processors (currently Stripe) to enable rent collection and security deposit payments via ACH transfer and other methods.
Indigo Lease does not hold, manage, or transmit funds. Landlords establish their own direct relationship with Stripe and are subject to Stripe’s terms of service, including any identity verification and know-your-customer (KYC) requirements. Tenants authorize payments directly to the Landlord’s connected Stripe account.
We are not responsible for payment failures, disputes, chargebacks, or any issues arising from the payment processing relationship between Landlords, Tenants, and Stripe.
6. Identity Verification
To use certain features of the Service, including payment processing, Landlords may be required to complete identity verification through our third-party payment processor. By using these features, you consent to the collection and verification of your identity information by the applicable third-party provider in accordance with their policies.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Violate any applicable local, state, national, or international law
- Upload or transmit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to discriminate against any person in violation of fair housing laws
8. Intellectual Property
The Service and its original content, features, and functionality are owned by Indigo Lease and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to the Service but grant us a license to use it as necessary to operate the Service.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDIGO LEASE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.
11. Indemnification
You agree to indemnify and hold harmless Indigo Lease and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, any lease or agreement you enter into through the Service, or your violation of these Terms.
12. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
